Compliance in Argentina

  • Opt-in: Opt-in is required and may be collected in any form accepted by the operators (web, call center, MO, paper form, etc.), and the content provider must be able to demonstrate proof of opt-in in the event of an operator audit or a user complaint.
  • Opt-out: Opt-out is required and the content provider is responsible for removing users from their database: on a dedicated short code the end user sends FIN or BAJA, and on a shared short code the message must include the program keyword together with FIN or BAJA (for example WU BAJA or WU FIN for a program using the keyword WU).
  • Restricted content: Adult content · Political content · Promotion of competing mobile networks
  • Registration: All promotional and marketing services on dedicated short codes must be approved by the operators in advance. The running program must always match the program initially submitted and approved by the operators.
  • Programs should support a HELP message as a best practice.
  • Operator policy prohibits traffic that promotes networks other than the one the SMS terminates on: messages to Personal may not mention Claro, Movistar or Nextel, messages to Claro may not mention Personal, Movistar or Nextel, messages to Movistar may not mention Claro, Personal or Nextel, and messages to Nextel may not mention Claro, Movistar or Personal; non-compliant messages will not be delivered.
  • No advertisement may be sent to a subscriber without their prior consent.
