Compliance in Brazil

  • Opt-in: Opt-in is required and any form is accepted by the operators (web, call center, MO and similar), but the content provider must be able to demonstrate proof of opt-in in the event of an operator audit or a user complaint.
  • Opt-out: Opt-out is required and the content provider is responsible for removing users who opt out from their database.
  • Sending times: Marketing messages may be sent Monday to Friday 8am to 6pm and Saturday 9am to 1pm (GMT-3), and promotional or marketing content may not be sent on Brazil public holidays.
  • Restricted content: Spam · Political content · Religious content · Sexual content
  • SMS traffic is heavily regulated by the operators in Brazil, and prohibited content is subject to fines and service termination.
  • Betting content is allowed only when approved.
  • Programs should support a HELP message as a best practice.
