Compliance in India
- Opt-in: For political SMS, liability for opt-in, content and penalties rests with the end entity undertaking the activity.
- Registration: A telemarketing license is required for domestic companies connecting directly with operators; qualification requires the sending server or application to be hosted in India and in some cases the entity's headquarters to be in India. Companies without an Indian entity use International Long Distance Operator (ILDO) connections; most operators and some domestic aggregators hold ILDO licenses that allow reselling to foreign companies. All political content must be pre-approved by the MCMC (Media Certification and Monitoring Committee) of the State Office of the Election Commission, and a certificate of approval from the MCMC is required when registering political SMS content.
- The Unsolicited Consumer Communications (UCC) regulations from the regulator TRAI took effect on 25 March 2019 and implement smarter filtering and traffic monitoring of A2P SMS to block senders deemed to be spamming.
- In India the term promotional SMS is used as a synonym for unrequested content.
- Political messages must adhere to pre-approved content only, and a self-declaration or affidavit on the approximate campaign or advertisement expenditure must be provided by the person or political party.
- A No Objection Certificate from the Prime Minister's Office is required if messaging content references the Prime Minister or his name, as per the Names and National Emblems Act, 1950.
- A 48 hour silent window must be observed for political messaging, as per section 126 of the Representation of the People Act, 1951.
- For political messaging campaigns, the ordering person or entity's authorisation and verifiable contact details (name, address, contact number, email address) must be retained at all levels for traceability, including across multiple entities.
