Compliance in Italy
- Opt-out: Under the Italian Privacy Code and GDPR every promotional or marketing SMS must include a clear and functional opt-out method, and because alphanumeric sender IDs do not support Reply STOP an alternative such as a URL link or toll-free phone number must be provided in the message body.
- Sending times: Transactional messages such as OTPs and alerts are allowed 24/7, while promotional messages are allowed only 09:00 to 20:00 Monday to Saturday and are strictly prohibited on Sundays and public holidays; marketing sent during quiet hours of 20:00 to 09:00 is classified as invasive and will likely be blocked by local operators.
- Restricted content: Cigarettes and other tobacco products marketing · Gambling advertising and promotional casino SMS · Political content (highly restricted, subject to carrier blocking) · Religious content (highly restricted, subject to carrier blocking)
- Casino traffic is legal only if the operator holds an official license from ADM, the Italian Customs and Monopolies Agency.
- Under Italy's Decreto Dignita, enforced by AGCOM, all gambling advertising and promotional SMS blasts are strictly prohibited; only purely factual transactional traffic such as OTPs, 2FA codes or basic account notifications sent to existing opted-in users is permitted.
- Sending unregistered or promotional casino traffic will trigger operator filters and can lead to AGCOM fines of up to 500,000 euros.
- The sender's identity must be clearly recognizable within the message so the recipient can easily exercise their right to object.
- Sending marketing on Sundays or holidays is the leading cause of consumer complaints in Italy and can trigger audits and significant financial penalties for the brand.
- SMS conduct in Italy is governed by the AGCOM Code of Conduct.
These rules are what we generally check against, however they may not be up-to-date. We'll always keep you informed of what is needed for each destination throughout any registration process.
