Compliance in New Zealand

  • Opt-in: All text services in New Zealand must use a double opt-in process.
  • Opt-out: Opt-out is mandatory for marketing and operators normally reject messages without an opt-out method, which may be a reply feature in the SMS such as Reply stop to opt out, an unsubscribe link in the SMS content, or explicit unsubscribe instructions in the terms and conditions such as contacting the call center.
  • Restricted content: Adult content · Political content · Gambling and anything promoting financial gain (such as Win Big!)
  • Services run over registered short codes must comply with the TCF Code (tcf.org.nz), and operators may set their own regulation and requirements for their network.
  • It is customary to keep client databases up to date and to regularly inform mobile users how they can unsubscribe.
  • Operators conduct random checks on services to ensure processes are followed and explained.
  • For standard-rated short codes the subscriber must be informed about charges when replying to the short code.
  • The SMS content must include the brand name to clearly identify the sender.

These rules are what we generally check against, however they may not be up-to-date. We'll always keep you informed of what is needed for each destination throughout any registration process.
